Except as otherwise required by applicable law, all vehicles are sold “AS-IS, WHERE-IS”, without any warranties, express or implied, including fitness for a particular purpose or merchantability. “Vehicle(s)” includes, without limitation, cars, trucks, motorcycles, boats, equipment, trailers, and RVs. Personal items/cargo inside a vehicle are not part of the sale; the buyer is solely responsible for handling any such contents in accordance with applicable law.

We do not guarantee the accuracy or completeness of any vehicle information (the “Vehicle Information”), whether written, verbal, or in images, including but not limited to: year, make, model, condition, damage type/amount, drivability, accessories, equipment, mileage/odometer, VIN/serial identifiers, title history, repair history, total loss history, or recall status. Keys and parts may be missing. Vehicles may not meet local emissions/safety requirements. You are solely responsible for researching, inspecting, and investigating vehicles before bidding.

We may disclose Member and transaction information to comply with applicable law, court/agency requests, or to prevent/respond to suspected illegal activity.

We may reject/void bids in our sole discretion as permitted by law. In any bid dispute, we are the exclusive deciding authority. You agree to indemnify us against claims arising from our dispute decisions.

We may postpone/cancel a sale or withdraw a vehicle at any time, with or without notice, and without liability. We may also cancel or reverse a sale to prevent fraud/illegal activity or for material listing errors. If payment was made, we will return it to the original form (where feasible) or credit your account.

In applicable cases, Live/real-time bids may prevail over equal prior bids.

Our Auto Bid tool places bids automatically, one increment above the current price, up to your set maximum. This may allow you to win below your max.

Seller Approval, and Countering. If a vehicle is designated “On Approval,” “Bid to be Approved,” or has a Minimum Bid that isn’t met, the high bid remains an open offer to the seller until 9:00 p.m. (local time) on the next business day following the auction. The seller may accept, reject, or counter during that period.

We may decline to release a vehicle or its document if we deem it necessary under applicable law or these Terms.

All bids are irrevocable and cannot be retracted, deleted, or cancelled.

Risk of loss passes to the buyer once the seller accepts your bid. From that point until removal, the vehicle is held as a bailee with limited liability: we are not responsible for damage/loss due to operational procedures, theft/vandalism, acts of God, or any claim made after the vehicle leaves the premises. We are only responsible for direct willful or grossly negligent acts. You (and your agents) must comply with loading/transport laws and ensure safe securement; you agree to indemnify us for damage/injury arising from improper loading/transport.

Purchased vehicles must be removed by 6:00 p.m. (local facility time) on applicable days, or additional gate/storage fees may apply.

Biometric/Identity Verification. You must be at least 18 years old and complete onboarding/screening (including ID verification and any required business/licensing information) to bid or purchase. We may deny or limit accounts in our discretion. Registration data is subject to our Privacy Policy. You agree to keep your information true, accurate, current, and complete.

Registered Bidder — May bid and purchase. Membership fee: $75 Membership fee (nonrefundable). Renewal and additional requirements may apply. We may change fee amounts at any time by posting an update.

Where permitted, visitors must comply with facility rules and staff instructions. No tools/repairs/dismantling on site. Do not remove items/paperwork from vehicles; report them to staff. Theft/damage is prohibited.

You are responsible for safeguarding your login and all activity under your account. No credential sharing. Notify us immediately of unauthorized use.

You must comply with all applicable laws and regulations regarding transportation, storage, transfer, and resale of purchased vehicles. We may restrict/suspend accounts if we suspect violations.

You are responsible for fines/penalties related to your vehicles (e.g., parking/tolls/liens/impounds). We may charge a processing fee per item and debit your account/payment method for the fine amount and processing fees.

You waive claims for injury/property damage on our premises (subject to applicable law). You agree to indemnify us for claims arising from your activities or those of your agents/visitors/customers. We do not warrant uninterrupted, error-free Platform operation; materials may contain inaccuracies. The Platform is provided “AS IS.”

You consent to receive marketing via then-current communication methods. See our Privacy Policy for opt-out.

Applicable buyer/member and transaction fees are shown on your account pages and may change without notice. You are responsible for checking fees before bidding.

Payment for vehicles/fees may only be made using approved payment methods shown in Payment Options on the Platform. We may restrict methods/limits or require pre-approval.

If a vehicle is not paid within the stated time after sale, we may cancel the sale in our discretion and charge a cancellation fee plus collection costs. Cancellation up till a purchase of $1-$4,000 -> fee would be $600. $4,000 and above is 15% of purchase price.

Payments you make are applied first to unpaid fees (membership, buyer, convenience, storage, loading/gate, late payment, cancellation, etc.), then to vehicle sale prices. We have no duty to release vehicles/titles until all fees are paid in full.
